Mar. 17th, 2011 02:58 pmПолгода назад местные блоггеры катили бочку на пытавшуюся переизбраться аврорского мера (мершу :) - Phyllis Morris. Филлис на выборах прокатили, и она подала в суд, на блоггеров, за хулу и клевету, хочет 6 лимонов.
В прошлую пятницу адвокат защиты требовал выкинуть дело фтопку. Адвокат обвинения (Mr. Clark) не соглашался, среди всего прочего выдвигая следующие тезисы:
- против модератора сайта:
Mr. Hogg is a moderator of the site with the power to "publish, republish, encourage, and delete" posts and is "jointly and severally responsible for defamation that anonymous defendants had stated" and authorized the publication of defamatory postings.
- против блоггера, который не удалил анонимный камент к своей статье:
Speaking specifically on the claims made against Mr. Johnson, Mr. Clark cited an article entitled "Council Watch"... A comment beneath the article, Mr. Clark went onto allege, congratulated Mr. Johnson on his writing, before going onto accuse Ms. Morris of being "one of the stupidest, most ignorant, lying hypocrites" they have had the misfortune of seeing or hearing.
"That is clearly defamatory," said Mr. Clark. "Nowhere... does Mr. Johnson disagree with that. He posted the article, someone said these defamatory words, they were not deleted by any of the moderators who had the power to do so, they were not disagreed with. That is sufficient."
и закончил свое выступление:
There is no question under Ontario law that a politician can defend her reputation from slanderous, defamatory comments.

Justice Spence told both parties that he was going to reserve his decision in the defence's motion to strike

Justice Robert Spence has denied the request made Friday to throw out Phyllis Morris' $6 million suit against three local bloggers.
The case is to go on...
